Executive Order — Assignment of National Security and Emergency Preparedness Communications Functions

With very little fanfare on Friday, Obama signed yet another executive order titled Assignment of National Security and Emergency Preparedness Communications Functions. (You can find the transcript of the executive order on the White House website for your own review.)

So, let’s see what authority Obama has granted for himself now.

As stated here, Obama has decreed that the federal government can take over all communications within the country in the event of an emergency. But the devil is in the details, so let’s jump in.

The rationale Obama provides for this order can be found in Section 1 —

The Federal Government must have the ability to communicate at all times and under all circumstances to carry out its most critical and time sensitive missions

Such communications must be possible under all circumstances to ensure national security, effectively manage emergencies, and improve national resilience.

One thing jumps out at me in this first section. Obama does not define what circumstances would be applicable to this situation anywhere in this order. So one has to wonder what is meant here. Obama supporters will tell you that only threats to national security would apply. But that is not what he wrote — “…under all circumstances to ensure national security…”

There is a difference. Any circumstance  can be used as a trigger for a government takeover to ensure “national security” with the wording provided here. (Remember what I wrote here.) That is how totalitarian regimes like Iran, Syria, and Egypt work. America is supposed to be different.

From Section 2 — Executive Office Responsibilities

…to the NS/EP Communications Executive Committee (established in section 3 of this order)…

And liberals want to know why people think they believe in big government. Yet another committee is formed by Obama. (Wonder if this one will meet as often as his jobs council does?)

advise the President on the prioritization of radio spectrum and wired communications that support NS/EP functions

So, they are telling him who should get what if “circumstances”  require him to act.

The Assistant to the President for Homeland Security and Counterterrorism and the Director of OSTP shall make recommendations to the President…with respect to the exercise of authorities assigned to the President…and…shall also jointly monitor the exercise of these authorities, in the event of any delegation…or as the President otherwise may direct.

This is Obama’s get-out-of-jail free card. Since actual leadership in a situation is something he is incapable of, Obama provided himself with a way out of actually making a decision. However, dictatorial control of our communications systems could possibly be delegated to someone other than the President. (I guess liberals are OK with Obama not doing his job because he is such a nice guy.)

Section 3 – The NS/EP Executive Committee

The Executive Committee shall be composed of Assistant Secretary-level or equivalent representatives designated by the heads of the Departments of State, Defense, Justice, Commerce, and Homeland Security, the Office of the Director of National Intelligence (DNI), the General Services Administration, and the Federal Communications Commission…

Did you read that? Not only does the President have the option to not have to make a decision, but neither does his Cabinet. (So, who’s going to actually be in charge here? Joe Biden??)

…coordinate the planning for, and provision of, NS/EP communications for the Federal Government under all hazards…

Notice Obama went from “circumstances” to “hazards” at this point. Maybe he is trying to define “circumstances.” So a hurricane, since it is a hazardous situation, can be a trigger for Obama to take over all communications within the country.

promote the incorporation of the optimal combination of hardness, redundancy, mobility, connectivity, interoperability, restorability, and security to obtain, to the maximum extent practicable, the survivability of NS/EP communications under all circumstances

There is a lot of technical mumbo-jumbo included to provide context, but look at the bolded portion. Obama is saying that the federal government communications has priority “to the maximum extent practicable.”

Section 4 – Executive Committee Joint Program Office

The Secretary of Homeland Security shall establish an Executive Committee Joint Program Office (JPO)…shall include detailees, as needed and appropriate, from agencies represented on the Executive Committee.

So, Obama has created two additional executive level committees within this one order. Then there are all going to be representatives from the same agencies represented on the Executive Committee. (No, that’s not big government at all.)

Section 5 – Specific Department and Agency Responsibilities

This is where the “rubber meets the road” and the scary part of this order comes into play.

The Secretary of Defense shall oversee the development, testing, implementation, and sustainment of NS/EP communications that are directly responsive to the national security needs of the President, Vice President, and senior national leadership…

Talk about ego. This should say “…the national security needs of the country…” but it doesn’t. Then it could include him in the list of things that would be included under those needs would entail. (So, in case of attack, you are on your own because the military will be defending him and not the country.)

…provide, operate, and maintain communication services and facilities adequate to execute responsibilities consistent with Executive Order 12333 of December 4, 1981…

This is the first scary part. Look at the first six words of this quoted text. The military will be required to “provide, operate, and maintain communication services” for the federal government. Translation — If the circumstances dictate, the military will be used to take over and run all communications in our country. (There is no other possible translation.)

Next we have the Secretary of Homeland Security who shall:

…satisfy priority communications requirements through the use of commercial, Government, and privately owned communications resources, when appropriate…

So, if Verizon has the capability, then Napolitano can take it from them, if circumstances dictate, and use it for federal government purposes with no defined limitations or timetables for return to the proper owner of said resources.

…serve as the Federal lead for the prioritized restoration of communications infrastructure and coordinate the prioritization and restoration of communications…

Once they take over our communications, the Secretary of Homeland Security gets to decide who gets to have their communications capabilities back first, or if at all. All the Secretary would have to decide is that you are not a priority.

…If conflicts in or among priorities cannot be resolved between the Departments of Defense and Homeland Security…

The White House would decide who gets what. (How did that work out with the IRS thing?)

It only gets worse from here. The Secretary of Commerce shall:

…develop plans and procedures concerning radio spectrum allocations, assignments, and priorities for use by agencies and executive offices…

So, the Defense Department and Homeland Security implement the physical takeover of communications and the Commerce Department will handle the administrative and technical aspects.

The Federal Communications Commission will be –

…providing the Secretary of Homeland Security with information…on communications infrastructure, service outages, and restoration, as appropriate…

It looks like the FCC will play the role of messenger in this takeover.

OK, the really frightening part in light of recent events.

…the DNI (Director of National Intelligence), after consultation with the heads of affected agencies, may issue such policy directives and guidance as the DNI deems necessary to implement this order…

So, the same people who have logged every single phone call, the same people who have access to every e-mail you have sent, the same people who have taken a picture of every single piece of mail sent, the same people who lied about data mining information on every American are going to be ones who are running the show.

If you are not afraid and angry at the same time, then you have not been paying attention.

    Man I can only think of one plan…Impeachment, he doesn’t want to do the job, make tough decisions but would rather delegate these things to to some ideologue that would love to push the progressive agenda in a time of national crisis.

    It is beyond time for Obama to go. He makes FDR look like a raving Republican by comparison. It’s really time to take our Country back from he who would rule like a dictator, and those who are letting him.
